These Conditions of Gamalia are the conditions on which Gamalia Tours & Transfers carries any person and their Tours as traveler, property and these conditions shall apply to each booking contract made for travel on Gamalia Tours & Transfers.
Any person who travels on Gamalia Tours & Transfers shall be considered to have agreed to be carried on the terms of these Conditions of Carriage.
By accessing and using any of the services offered by us, whether verbally or in writing, whether for booking accommodation, catering, activities, transfer, tours, other hospitality / tourism services not mentioned, or asking advice, by our website, or asking for a consultation, or other services all parties agree to be bound by the terms and conditions set out herein.
Please DO NOT use our services if you do not agree to be bound by these terms & conditions. We may at any time modify these terms & conditions and your continued use of our services will be subject to the terms and conditions in force at the time of your use. Accordingly we kindly request that you review these terms and conditions each time you want to make use of our services as your continued access or use of our services shall be deemed to signify your acceptance of the amended terms and conditions. We reserve the right at any time to change or discontinue, without notice, any aspect, feature or service offered by way of any of our communications, adverts, websites or promotions.
We furthermore reserve the right to refuse assistance to any prospective client wanting to make use of any of our services or products at any time, without discussion or explanation.
1. All reservations on thetours and Transfers, amendments and cancellations will only be accepted in writing, E-mail. Quotations will be provided on request for any services not specified in this price list. Such quotations are subject to adjustment, if the services originally quoted for are not available at the time of booking.
In these Conditions of Transfers, the following words shall have the following meanings:
Additional Luggage means the luggage in addition to the Luggage allowance permitted for that Gamalia Transfers route. Additional luggage (up to two pieces each with a maximum total dimension (Height + Width + Length) of 145 cm (57 inches) and weighing in total no more than 60 Kgs) must be carried on a seat (additional to the one you have reserved for your carriage), which must be booked and paid for in advance.
2. Full payment is required in advance, prior to commencement of Gamalia Tours services.
The payment options will be provided upon confirmation of a booking.
3. Booking Confirmation means a print out of the document published on the Internet or email sent by us, or on our behalf, to the person making the booking which sets out our agreement to carry or arrange for the carriage of any person, including the services on which travel is booked and the fare paid.
4. Voucher Number (Reference Number) means the reference number allocated to each passenger booking. It is the means by which an individual booking is identified by Online Booking.
5. Luggage Allowance means the two pieces of property, which you may bring onto an Gamalia Transfers without charge.
6. Cancellation Policy
If a confirmed reservation is cancelled, cancellation fees will be levied as follows:
If a passenger fails to join a tour, or joins it after departure, or leaves it prior to completion, no refund or rebate will be made. No refunds will be made for any services booked in advance but not utilized for any reason whatsoever.
If the booking is cancelled, the following fees apply relative to the amount of notice given:
Please note: The notice period is calculated from the date of cancellation to the start date of the tour/safari booking.
No refund will be made by the Company if, for any reason, inclusions or parts of the tour cannot be carried out / or utilized. These would include all facets such as meals, game drives, accommodation etc. This would also apply to any client who has booked a tour but fails to undertake the tour for any reason
Gamalia reserves the right to increase the price of any tour prior to departure due to factors beyond the control of the Company, such as, without being limited to, and increase in fuel prices, new Government legislation, accommodation price increases, fluctuations in exchange rates, etc.
If the Company announces an in increase in the tour price in terms of this Clause, such addition amount must be paid to the Company before the departure of such tour or else the Company shall have the right to cancel the tour and the charges.
Gamalia shall at any time have the right, in its entire discretion, to alter the terms of the booking in relation to the route, timetable, itinerary and accommodation. Gamalia shall, however, make every effort to offer the client an alternative tour of a comparable standard.
Should the alternative be of a lesser standard, the client will be refunded the difference, but should there be an increase, the client shall have the right to either reject the alternative or obtain a refund of the relevant portion of the original contract sum, or to accept the alternative and pay the increased cost. In the event of the client rejecting the alternative tour and claiming a refund, such rejection will be treated as a cancellation and the refund will be calculated according to Clause 4.2 hereof. The client shall have no claim against the Company for any damages arising out of the alternative booking.
The responsibility is upon the client to ensure that passports and visas are valid for the duration of the safari. The Company cannot be held liable for any necessary visas or other travel documents not held by clients. In the event of a client not having the necessary documentation to enter any area or country the Company shall reserve the right to leave the client a the point of entry of such area or country. In such an event, the Company will not be held responsible to the client for further travel arrangements.
